Mr. Potter has accepted a retainer for the
Government.
2. An action claiming $40,000 was commenced by Writ of Summons in the name of the Attorney General v. The Electric
Traction Co. of Hongkong, Action No.48, of 1910, on the 18th
Messrs.Deacon Looker & Deacon have appeared for the
instant.

3. An order for the de bene esse examination of Mr.
Gale was made on the 20th instant in the face of strenuous
opposition by the defendants, and Mr. Gale was examined on the
21at instant. Mr. H.L.Dennys Senr. conducted the examination
and Mr. H.W.Looker the cross-examination.
4. On the suggestion of the Director of Public Works
and Mr. Bale Mr. Dennys approached Mr. Carter, the Manager of the China and Japan Telephone Co. to ascertain if he would assist
the Government.
After consideration dr. Carter stated that he
preferred to remain neutral, as he has been consulted by Mr. Gray Scott in England, and by the Co's representatives in
Hongkong.
5. Mr. Carter however thinks that the Co. might
consent to refer the question of amount payable to the arbi- tration of experts e.g. The Manager (or Electrician) of the Eastern Extension Cable Co. (whom I have already consulted), Mr. Carter, and the Chief Electrical Engineer of the Naval Yard.
6. I think such a reference would be very satie-
factory and request permission to approach the Co's solicitors on the subject (without prejudice to the law suit).
